OFFERED AND OPEN ONLY TO LEGAL RESIDENTS OF THE 50
UNITED STATES AND DISTRICT OF COLUMBIA WHO RESIDE IN AND
ARE PHYSICALLY LOCATED IN THE U.S. AND D.C., AND WHO ARE
18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. Void in
Puerto Rico and other U.S. territories and possessions.
Sweepstakes begins March 1, 2008, and ends on June 20,
2008. This sweepstakes is sponsored by Mattresses4Backs
("Sponsor").
1.
ELIGIBILITY:
Employees of Sponsor and its representatives,
suppliers, and advertising and promotion agencies; their
respective divisions, subsidiaries, and affiliated
companies; and the immediate families and same household
members of each of them are not eligible to enter or to
win the sweepstakes. Web sites which deliberately
spam online contests and the traffic and or contest
submissions generated by such practices
are not eligible to enter or to win the sweepstakes.
Such entrants are automatically disqualified.
2.
HOW TO ENTER: Simply register with your email
address using the form above. Sponsor and its agencies are not responsible for
incorrect email addresses . Entries become the property
of Sponsor. No form of entry other than specified herein
is permitted; use of automated, programmed, robotic, or
similar forms of entry is prohibited. All entries become
the exclusive property of Sponsor.
3.
DRAWING:
On or about August 29, 2008, a random drawing will be
conducted in compliance with these Official Rules by a
Sponsor representative from the office of Mattresses
Direct Inc. The drawing will be conducted from all
eligible entries submitted. Odds of winning a prize
depend on the number of eligible entries received. All
information pertaining to the number of entries will be
kept confidential. Prize winner will be notified by
mail, telephone, or private delivery service (at
Sponsor's sole discretion), within 10 days of the
drawing, at the address or telephone number indicated on
their entry form.
4.
PRIZE:
One (1) Grand Prize: A Magniflex Queen-Size Memory Foam
Duoform Classic Mattress (Foundation not included). Approximate Retail Value
("ARV"): $1,749.00. Prize is not transferable. Winner
must comply with all terms and conditions set forth in
these Offcial Rules and winning is contingent upon
fulfilling all such requirements. Winner will be
required to complete an Affidavit of Eligibility and
Liability and Publicity Release (except where
prohibited) and W-9 form, to be returned within (14)
days of the date printed on winner's notification
letter, or the prize will be forfeited and an alternate
winner will be selected from all remaining eligible
entries received. If prize notification for prize is
returned as undeliverable, prize will be forfeited and
an alternate winner will be selected from all remaining
eligible entries received. No cash redemptions or prize
substitutions will be allowed except at Sponsor's sole
discretion, due to prize unavailability for any reason
and only then for a prize of equal value. All taxes,
fees, and surcharges on prize are the sole
responsibility of winner.
5.
GENERAL CONDITIONS/DISCLAIMER:
By entering or participating in this sweepstakes,
participants: (a) agree to these Official Rules and the
decisions of the Sponsor, which shall be final and
binding in all matters relating to the Sweepstakes; and
(b) agree that the Sponsor; their respective parents,
subsidiaries, affiliates, retailers, and advertising and
promotion agencies; and all of their respective
officers, directors, employees, representatives, and
agents are not responsible for errors. (c) By accepting
a prize, winner agrees to indemnify and hold harmless
Sponsor; their advertising and promotion agencies; and
each of their respective officers, directors, employees,
and representatives from and against any injuries,
claims, damages, or losses of any kind that arise from
or are sustained in connection with acceptance or
use/misuse of prize or from participation in the
sweepstakes or in any prize-related activities. (d) By
accepting a prize, winner agrees that the Sponsor and
those acting under its authority may use winner's name,
picture/portrait, likeness, and/or voice for
advertising, trade, and promotional purposes in
perpetuity and in any media without notification or
additional compensation, unless prohibited by law.
Sponsor; their parents, subsidiaries, affiliates,
retailers, and advertising and promotion agencies; and
all of their respective officers, directors, employees,
representatives, and agents are not responsible or
liable for: misdirected, late or lost entries; (2)
errors or delays in transmission of entries; (3) any
condition caused by events beyond the control of the
Sponsor that might cause the sweepstakes to be disrupted
or corrupted. The Sponsor may prohibit you from
participating in the sweepstakes, at their sole
discretion, if you repeatedly show a disregard for the
sweepstakes' Official Rules or act: (a) in a manner they
determine to be not fair or equitable; (b) with an
intent to annoy, threaten, or harass any other entrant
or the Sponsor; or (c) in any other disruptive manner.
Sponsor is not responsible for prize utility or quality.
Sweepstakes is subject to all applicable federal, state,
and local laws and regulations.
6.
PRIVACY:
Information participants provide to Sponsor may be used
to communicate with participants in relation to this
Sweepstakes as well as for other purposes as described
in the Sponsor's Privacy Policy available at
www.mattresses4backs.com
Winner's name, age, city and state of residence may be
posted on the Mattresses4Backs Web site.
7.
NAME REMOVAL NOTIFICATION SYSTEM:
To have your name and address removed
from the Mattresses4Backs sweepstakes/contest mailing
list, send a written request to Mattresses4Backs, at
contest@mattresses4backs.com . Be sure to include in
the request your full name and address and specifically
indicate that you wish to be removed from the mailing
list. Your request will be processed within 60 days
after receipt, after which time no further
sweepstakes/contest mailings will be sent to you.
8.
WINNER'S NAME/RULES REQUESTS:
You may obtain the winner's name by
sending a self-addressed, stamped envelope by August 29,
